A tenant, Mr. Charles Farimoyo, has approached a Lagos Magistrates’ Court over alleged breach of contract by his landlady, asking the court to award N5m in damages in his favour.
In a suit marked MCL/1450/15 filed before the court sitting in Tinubu, Lagos Island, the claimant, Farimoyo, through his counsel, Seyi Omodara, also demanded that the landlady should refund the sum of N8m he claimed to have paid to his landlady for two years’ rent.
The house, a four-bedroomed flat and a Boys’ Quarter, is located on Abayomi Sonuga Street, Lekki Phase 1, Lagos while the rent was effective between April 1, 2014 and March 31, 2016.
The claimant alleged that towards the expiration of a year rent he initially paid, the defendant increased the rent to N4.5m because he could not pay another N4m on the agreed date.
In the application before the magistrate, Mr. A. Adefulire, the claimant’s counsel said the landlady had requested his client to allow her use the Boys’ Quarter, adding that he consented after much pleading.
He said, “Pursuant to the above, the defendant pleaded with the claimant that she will like to embark on a minor repair of the BQ kitchen cabinet and replacement of entrance door. However, to the claimant’s greatest surprise, the defendant embarked on a total renovation and reconstruction of the said BQ.
“Pursuant to the renovation and reconstruction embarked on my the defendant, the whole premises is in total disarray as the labourers working on the BQ litter the whole premises, defecate openly and keep the faeces within the premises, worked late and make unnecessary noise at midnight, thereby disturbing the claimant’s peaceful sleep.”
